1. Acceptance of Terms

Welcome to PlayParty Kids. By accessing and using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and PlayParty Kids. If you do not agree with any part of these terms, please do not use our services. We reserve the right to modify these terms at any time, and your continued use of our services following any changes indicates your acceptance of the revised terms.

2. Service Description

PlayParty Kids provides professional children's party organization services including but not limited to event planning, entertainment, decorations, games, contests, shows, and related activities. Our services are designed for children aged 3 to 12 years and their families in Adelaide, Australia. All services are subject to availability and must be booked in advance. We reserve the right to refuse service to anyone for any reason at our sole discretion. The specific details of each party package are outlined in our pricing section and booking confirmation.

3. Booking and Payment

All bookings require a non-refundable deposit of 30% of the total package price to secure your reservation. The remaining balance must be paid no later than 7 days before the scheduled event date. Payment can be made via credit card, bank transfer, or other approved methods. Failure to pay the balance on time may result in cancellation of your booking and forfeiture of your deposit. All prices are quoted in Australian Dollars (AUD) and include GST where applicable. Additional services requested on the day of the event may incur extra charges payable immediately.

4. Cancellation and Rescheduling Policy

Cancellations made 14 or more days before the scheduled event date are eligible for a full refund minus the booking deposit. Cancellations made between 7-13 days before the event will receive a 50% refund of the total amount paid. Cancellations made less than 7 days before the event are non-refundable. Rescheduling requests made at least 7 days in advance are accommodated at no additional charge, subject to availability. We understand that unexpected circumstances arise, and we will work with you to find reasonable solutions. In cases of extreme weather or circumstances beyond our control, we will contact you to discuss alternatives.

5. Client Responsibilities

Clients are responsible for providing accurate information regarding the event venue, number of guests, ages of children, and any special requirements or allergies. You must ensure that the venue is safe and suitable for the planned activities and that you have obtained all necessary permissions to use the space. Adult supervision must be present throughout the event. Clients must inform us of any medical conditions, behavioral issues, or special needs that may affect the safety or enjoyment of attendees. You are responsible for the behavior of your guests and any damage to property caused during the event.

6. Liability and Insurance

PlayParty Kids maintains comprehensive public liability insurance and takes all reasonable precautions to ensure the safety of participants. However, we cannot be held liable for accidents, injuries, or losses that occur during events due to factors beyond our reasonable control. Parents and guardians are responsible for supervising their children throughout the event. We are not responsible for personal belongings lost or damaged during parties. Our liability is limited to the total amount paid for the service. By booking our services, you agree to indemnify PlayParty Kids against any claims arising from your event.

7. Intellectual Property

All content on the PlayParty Kids website, including text, graphics, logos, images, videos, and software, is the property of PlayParty Kids or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without explicit written permission. Our party concepts, game designs, and entertainment formats are proprietary and may not be copied or used for commercial purposes. Any photographs or videos taken during events may be used by PlayParty Kids for marketing purposes unless you explicitly opt out in writing.

8. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and applicable Australian privacy laws. By using our services, you consent to the collection, use, and storage of your personal information as described in our Privacy Policy. We implement appropriate security measures to protect your data but cannot guarantee absolute security. We will never sell your personal information to third parties. 9. Code of Conduct

We expect all clients and guests to treat our staff with respect and courtesy. Abusive, threatening, or discriminatory behavior toward our team members will not be tolerated and may result in immediate termination of services without refund. Our staff have the right to refuse service or remove individuals whose behavior compromises safety or enjoyment. We promote an inclusive environment and do not discriminate based on race, religion, gender, disability, or any other protected characteristic. All activities are designed to be fun, safe, and appropriate for children. Parents should inform us of any concerns immediately.

10. Force Majeure

PlayParty Kids shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government restrictions, strikes, equipment failure, or other unforeseen events. In such cases, we will make reasonable efforts to notify you as soon as possible and offer alternative dates or a refund of amounts paid. Our liability in force majeure situations is limited to refunding payments for services not rendered. We appreciate your understanding in such exceptional circumstances.

11. Amendments to Services

We reserve the right to make reasonable substitutions to entertainment, activities, or materials if unforeseen circumstances require changes. We will always strive to provide equivalent or superior alternatives and will notify you of significant changes as soon as possible. In rare cases where we cannot fulfill our obligations, we will offer you a full refund or the option to reschedule. Our goal is always to exceed your expectations, and any changes made are intended to maintain or improve the quality of your event experience.

12. Health and Safety

All our activities comply with Australian safety standards and regulations. Our staff are trained in child safety and hold current Working with Children checks and First Aid certifications. Equipment and materials used are regularly inspected and maintained. If a child appears unwell or injured during an event, our staff will notify the parent or guardian immediately. We require disclosure of any allergies, medical conditions, or special needs that may affect participation. Parents are responsible for ensuring their children are healthy enough to participate in physical activities. We follow strict hygiene protocols for all events.

13. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of South Australia, Australia. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of South Australia. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision unless acknowledged in writing by us.
